1. Introduction

1.1 This website is owned by International Youth Hostel Federation (IYHF) operating as Hostelling International (“HI”). HI is registered in England and Wales under company number 02250706 and charity number 1117014 and has its registered office at Fretherne Road, Welwyn Garden City, Herts AL8 6RD, UK. 1.2 These terms and conditions govern your use of this website ("Website") produced by HI.

1.3 Please read these terms and conditions carefully. Your use of the Website will constitute your agreement to comply with these terms and conditions.

1.4 If you do not agree with these terms and conditions, please do not use the Website.

1.5 These terms and conditions may be modified by HI from time to time. Notice of revisions will be announced on this page. Continued use of the Website by you will constitute your acceptance of any changes or revisions to these terms and conditions, so it's wise to check this page regularly.

1.6 Your failure to follow the Website's rules whether set out in these terms and conditions or specified on any webpage of the Website, may result in termination of your access to the Website, without notice, in addition to HI other remedies.

1.7 HI may update the Website from time to time, and may change the content at any time. However, please note that any of the content on the Website may be out of date at any given time, and HI is under no obligation to update it. 2. Use of the Website by You

2.1 All material on the Website belongs to HI. You may retrieve and display content from the Website on a computer screen, print individual pages on paper (but not photocopy them) and store such pages in electronic form on disk (but not on any server or other storage device connected to a network) for your own personal, non-commercial use. You may not in any way make commercial or other unauthorised use, by publication, re-transmission, distribution, performance, caching or otherwise, of material obtained through the Website.

4. Use of Material Posted by You & Other Applicable Terms

4.1 All information and material you supply or communicate to and on this Website is governed by the Privacy Policy, which sets out the terms on which we process an personal data we collect from you or that you provide to us. 4.2 The terms and conditions for “The Big Blog Exchange” competition can be found here [see below] which sets out information about the competition. When using this Website you must comply with those terms and conditions.

4.3 Cookies are small amounts of information that are sent to and are stored on your computer. They are used to identify you when you visit the Website, and to make your use of the Website more convenient for you. Cookies are used to remember usernames, passwords and preferences and to deliver a faster and more personalised service. If you do not wish to have Cookies placed on your computer you can disable Cookies on your Internet browser. Turning them off however will mean that you will not be able to enjoy this Website to it’s fullest.

5. Complaints

5.1 Much of this Website will consist of content from a variety of contributors. However, HI does not exercise any editorial control over entries and does not warrant or guarantee to review, monitor, edit, move or delete content. However, HI does have a system in place to allow for users of this Website to report complaints relating to content as is specified in this clause 5.

5.2 HI respects the intellectual property of others, and we ask our users to do the same. HI may, in appropriate circumstances and at its sole discretion, terminate the access of The Big Blog Exchange competition Participants who infringe the copyright rights of others.

HI may suspend, withdraw, discontinue or change all or any part of the Website without notice.

8.3 Save for the provisions of the following clause HI and its affiliates shall not be liable to you or any third parties for any direct, indirect, special, consequential or punitive damages allegedly sustained arising out of your access to or inability to use the Website, including for viruses alleged to have been obtained from the Website, your use of or reliance on the Website or any of the information or materials available on the Website, regardless of the type of claim or the nature of the cause of action, even if advised of the possibility of such damages.

8.4 HI’s liability will not be limited in the case of death or personal injury directly caused by HI’s negligence.

9. Choice of Law and Jurisdiction

9.1 These terms and conditions shall be governed by the laws of England and Wales. You also agree, subject to the following clause, to submit to the exclusive jurisdiction of the English courts as regards any claim or matter arising under these terms and conditions.

9.2 For the exclusive benefit of HI, HI shall retain the right to bring proceedings as to the substance of the matter in the courts of the country of your residence.

10. General

10.1 If any of these terms and conditions are found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect.

10.2 Failure of either to exercise any right or remedy under this Agreement does not constitute a waiver of that right or remedy.

The purpose of this privacy policy is to inform you what personal information HI collects and the purposes for which it uses this information. For the purposes of the Data Protection Act, HI is the Data Controller.

2. Disclosures

2.1 When you use HI Websites you are consenting to the disclosure of your personal information to HI’s partners. HI may disclose your information, under strict terms of confidentiality and restriction of use, to partners of HI who supply services on behalf of HI and who need to process personal data in the provision of such services.

2.2 HI will not disclose any of your personal information to any other third parties without your express consent. However, under certain circumstances the force of law may require the provision of information to legal authorities. In order to maintain the integrity of its Websites and safeguard the interests of its subscribers HI will comply with any such legally binding request.

3. Information Collected

3.1. Identifiable information - Your information is collected when you register or fill in a form on an HI Website, or you send an email to HI. The information that is provided by you will only be used for the purpose for which it is provided, unless you are informed otherwise at the time of giving the information. 3.2. Non identifiable information - HI will from time to time collect information from you that does not reveal your personal identity. HI uses this information for editorial purposes, and occasionally for other internal purposes. We may use this information to:

3.2.1 ensure that the content of our Site is presented in the most effective manner for you and for your computer and customise the Site to your preferences;

3.2.2 assist in making general improvements to our Site;

3.2.3 carry out and administer any obligations arising from any agreements entered into between you and us;

3.2.4 allow you to participate in features of our Site and other services;

3.2.5 contact you and notify you about changes to our Site or the services we offer (except where you have asked us not to do this);

4.1 HI processes personal information for the purpose of providing a personalised service, conducting market research surveys and running competitions. HI may also contact you with important information about your registration details.

7. International Transfers

7.1 HI shall take steps to ensure that any transfer of data to a country or territory outside the European Economic Area, whose laws provide for a different standard of protection for your personal data than that provided under English law, shall be made subject to contractual arrangements which will require that your data be processed to at least a standard compliant with the Data Protection Act 1998.

8. Security

8.1. HI Websites have security measures in place to protect against loss, misuse and alteration of your personal information under HI’s control. However, no data transmission over the Internet can be guaranteed to be 100% secure and whilst HI strives to protect your personal information, HI cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk. Once HI receives the transmission, HI makes all reasonable efforts to ensure the security on the system.

HI is not intended for use by children, especially those under age 12. No one under age 12 is allowed to provide any personal information. Minors between the ages of 12 and 17 must get the permission of their parent(s) or legal guardian(s) before subscriptions, on this site.

COMPETITION TERMS & CONDITIONS

1. Introduction

1.1 International Youth Hostel Federation operating as Hostelling International (“HI”) is running the “Big Blog Exchange” Competition (the ‘Competition’). HI is registered in England and Wales under company number 02250706 and charity number 1117014 and has its registered office at Fretherne Road, Welwyn Garden City, Herts AL8 6RD, UK. Its VAT number is 196 6417 24.

1.2 Information on how to enter this Competition and detail of the prize form part of the Terms and Conditions below. By taking part in this Competition, Participants confirm that they accept the Terms and Conditions.

1.3 The following additional terms also apply to the Competition:

1.3.1 HI’s Website Terms and Conditions which can be seen here [see above]; and

1.3.2 HI’s Privacy Policy which sets out the terms on which we process any personal data we collect from you, or that you provide to us, which can be seen here [see above].

2. Eligibility

2.1 This Competition is only open to eligible Participants. An eligible Participant is a person who has reached the age of 18 years old on or before 15 April 2013, possesses a valid passport (valid for at least eight months from 15 April 2013) and is the author of the blog being entered. HI reserves the right to verify the eligibility of Participants.

2.2 The Competition is open to any type of blog (e.g. cupcakes, politics, travel, fashion, beauty, personal, diaries, photography, video blogs, etc.). This Competition is not limited to travel blogs specifically.

2.3 The following people are not eligible to enter the Competition: (a) employees of HI and employees of HI member associations and (b) the jury panel and their immediate family members. They will be disqualified if they enter.

2.4 This Competition is subject to UK and all other applicable national, federal, state, and local laws and regulations. It is the responsibility of each Participant to ensure that they comply with the laws that govern them in the jurisdiction in which they are resident. This Competition is void where a country’s laws would prohibit it. Participation in this Competition is at each Participants sole option and risk.

3. When You Can Enter

3.1 Participants can submit their blogs and members of the public can vote for their favourite blogs between 12:01 p.m. GMT on 1st March 2013 and 11.59 a.m. GMT on 15th April 2013 (the ‘Entry Period’) by visiting www.bigblogexchange.org.

3.2 When voting in either the Entry Period or Travel Period (see clause 9 below) members of the public are required to provide their email address. The personal data provided will be used in accordance with HI’s Privacy Policy [see above].

4. How to Enter

4.1 To enter, you must visit the Competition page during the Entry Period on www.bigblogexchange.org and complete the form. You are required to enter your name, gender, date/year of birth, nationality, country of residence, blog name, email address, link to your blog, tags, photo caption and a description of “my motivation” No other means of entry will be accepted.

4.2 For the avoidance of doubt, nationality is means the country for which a Participant holds a valid passport. Nationality is not related to a person’s country of residence. Where a Participant holds a valid passport for more than one country the Participant is free to choose whichever nationality he or she wishes to enter with.

4.2 Proof of submission is not proof of receipt. No responsibility can be accepted for entries not received for whatever reason. Late, illegible, incomplete, defaced or corrupt entries will not be accepted.

4.3 HI accept no responsibility for damage or loss resulting from misdirected or incomplete entries arising from computer malfunction, viruses, bugs or telephone malfunction or other such causes. HI has no responsibility for any malfunction, delay, loss or damage caused by its Website, its malfunction, or the actions of its administrators.

4.4 Entries submitted without all of the information required will be disqualified.

5. Other Requirements Related to Entry

5.1 The blog specified must be made by the Participant themselves and they must be the Authorized Account Holder of the e-mail address submitted at the time of entry. "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, internet domain owner, or other person or organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

5.2 The blog specified and the description of “my motivation” must be the Participant’s own work. It is the responsibility of each Participant to ensure that any blog they submit has been, where applicable, made with the permission of the subject and does not infringe any intellectual property rights of any third party laws or contain any obscene, indecent or offensive language, or any material that is false, defamatory, abusive, harassing, hateful, obscene, indecent, offensive, distasteful or controversial. Participants warrant that the blog they are submitting is their own work and that they own all intellectual property rights in it.

5.4 HI reserves the right to disqualify entries showing the name, logo or other protected Intellectual Property of a company or an individual, or where it reasonably suspects that a Participant does not own the copyright in their entry.

5.5 HI reserves the right to disqualify any entries that have not been submitted correctly or that breach its Website terms and conditions [see above] and Privacy Policy [see above].

5.6 Once an entry is submitted, the Participants blogs will appear together with their name, nationality, gender and age on the Big Blog Exchange website.

5.7 Only one entry per person is allowed and any Participant who enters more than once will be disqualified.

5.8 Participants may withdraw from the Competition at any time by writing to TBBE@hihostels.com.

5.9 Copyright in all blogs submitted for this Competition remains with the Participants. However, in consideration of their providing the Competition prize, each Participant grants a royalty- free worldwide, irrevocable, perpetual licence to HI, HI to feature any or all of the submitted blogs in any of their publications, their Websites and/or in any promotional material connected to this Competition, including on www.bigblogexchange.org website.

6. The 100 Finalists

6.1 During the Entry Period, members of the public can vote for as many blogs as they want but can only vote for each blog once. Participants may vote for themselves.

6.2 There are four regions- Africa & Middle East, America, Asia Pacific and Europe. To see the list of countries and nationalities within each region please click here [link to FAQ where the list is].

6.4 The 25 Participants from each region with the largest amount of votes will qualify to be finalists.

6.5 Despite what is written in section 6.4 at most 10 finalists will be allowed from the same country.

6.6 Where there are not sufficient numbers of Participants or nationalities within each region to fill the 25 places available, HI reserves the right to fill the place(s) with the Participant(s) in any particular region who have next highest amount of most votes, regardless of their nationality.

6.7 The list of the 100 finalists will be shown on www.bigblogexchang.org from 12:01 p.m. GMT on 16th April 2013, or alternatively, the list of names can be obtained by sending an email to TBBE@hihostels.com between 12:01 a.m. GMT on 17th April and 11:59 p.m. GMT on 1st June 2013.

7. The 16 Winners

7.1 The 16 winners (“Winners”) are formed of 14 selected out of the 100 finalists by the jury panel and two wild cards out of all Participants (regardless of the number of votes they have) selected by the jury panel.

7.2 All Winners will be selected by the sole discretion of the jury panel according to an agreed selection criteria.

7.3 The jury panel’s decision is final, and no correspondence will be entered into about the jury panel’s decision.

7.4 The names of the Jury Panel will be made available on request. Requests must be made by emailing TBBE@hihostels.com.

7.5 The Winners will be contacted by email only by 10 a.m. GMT 24th April 2013. The Winners must reply to the email, indicating their acceptance of the prize, in the manner prescribed in the email, by 10 a.m. GMT 27TH April 2013. In the event of failure to do so, HI reserves the right, in its sole discretion, to select an alternative Winner from the relevant region and based on the amount of votes received.

7.6 The Winners will be listed on www.bigblogexchange.org by 29th April 2013. Any changes to the Winners list will be made as soon as practicably possible.

8. The Prize Won by the 16 Winners and Associated Terms

8.1 The 16 Winners will each travel to the country of the nationality (the ‘Exchange Country’) of one of the other 16 Winners.

8.2 The Exchange Country and destination (the ‘Destination’) of each Winner will be decided by a lot that will take place on 29th April 2013, 7:00 am. GMT. The lot can be viewed live via www.bigblogexchange.org.

8.3 The Winners and their Destinations will be listed on www.bigblogexchange.org by 7:00 am. GMT on 29th April 2013. Any changes to the Destinations list will be made as soon as practicably possible.

8.4 The Winners must be available to travel to their Destination departing on 7th of June 2013 and returning on 17th of June 2013 (‘Travel Period’) (GMT).

8.5 The Winners must have no criminal convictions, outstanding court summons or any legal reason that they would be unable to travel to their Destination between 7th of June 2013 and 17th of June 2013 (GMT).

8.6 Prior to the Travel Period, the Winners will be required to provide to HI contact details of his/her next of kin and to sign a letter to confirm their acceptance of these terms and conditions.

8.7 During the Travel Period the Winners must be running their blogs on a platform that allows RSS, RSS2 or Atom feeds from their blog and their blogs must have the google translate facility.

8.8 HI acknowledges that depending on the Destination, internet connection may be limited. All Winners are expected to use all reasonable endeavours to post blogs during the Travel Period and from their Destination. HI may edit and re-publish the Winners’ blog posts, and tweets, and any photographs which the Winners may take during the Travel Period, in any online or off-line publication published by HI.

8.9 During the Travel Period the Winners are expected to post their blogs on the blog page and/or link their blog with the Winner that has travelled to a Destination within their Exchange Country.

8.10 HI will provide flights (from the closest available international airport to the Winner to the nearest available international airport to the Destination), accommodation in a member National Association hostel , and £50 (fifty pounds GPB) daily subsistence allowance (DSA) with a maximum of £500 per winner. HI may, at its sole discretion, provide transfers from the airport to the Destination.

8.11 Any other expenses are the sole responsibility of each Winner.

8.12 The Winners are solely responsible for supplying valid passports and visas and obtaining vaccinations that may be required to visit the destination that is their prize.

8.13 HI recommends that all Winners consider purchasing travel and medical insurance prior to commencing any travel.

8.14 HI is not responsible for cancellation, delays or changes to flights or for the inability of a Winner to take further part in the Competition due to problems with flights, travel or any other factor outside HI’s control.

8.15 The Winners will before arrival at their Destination, get an itinerary for their Travel Period and are expected, where reasonable , to participate in different activities organised by the member National Association hostel that is providing their accommodation. Each itinerary is compiled and paid for by each member National Association hostel and the activities provided are based on availability. HI does not guarantee that the number and nature of activities provided to each Winner will be the same or comparable.

8.16 Winners’ personal spending money for the duration of the trip shall be his/her own responsibility and so each Winner must therefore ensure they have sufficient financial resources to meet any further financial commitments, which may occur during the Travel Period.

8.18 The Winners may be required for promotional activity and HI reserves the right to use their names and photographs in any publicity both in paper and online.

8.19 Except where prohibited the Winners’ consent to HI’s and its agents’, use of any Winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration for advertising and future promotional purposes without additional compensation.

8.20 The Winners will assume sole responsibility for his/her own actions and their own safety during their trip. The Winners agree to act in accordance with any reasonable instructions given to them by or on behalf of HI, member National Association hostel or its partners, to reasonably adhere to any itinerary given to them by HI or its partners during the Travel Period, to act at all times with due and proper consideration for others and to observe and respect and abide by any applicable local laws, guidelines or customs. HI accepts no responsibility for and excludes all liability to the fullest extent permitted by law for any breach by any Winner of this clause and for any Winner’s own actions and their own safety during the Travel Period for such periods when they are not accompanied by representatives of HI and/or the member National Association hostel or its partners on any organized element during the Travel Period providing that HI does not seek to exclude any liability to any Winner for any death or personal injury caused by the negligence of HI.

8.21 Once they are back from their exchange the Winners shall submit a final “Blogger Manifesto”; a summary of their experiences, learning, and proposals during the Travel Period which shall be at least 700 words long.

9. Voting During the Travel Period

9.1 During the Travel Period, the voting process will be reopened to determine who will be the final winner (the ‘Final Winner’) of the Competition. The voting shall open at 12:01am GMT on 7th June 2013 and close at 11:59 pm on 17th June 2013.

9.2 Members of the public may only vote for one blog and can only vote once. Winners can vote for themselves.

9.3 All votes previously submitted in the Entry Period shall not be carried forward.

9.4 The Winner with the most amounts of votes shall be named the Final Winner.

9.5 The Final Winner shall be announced on 18th June at www.bigblogexchange.org.

9.6 The Final Winner does not receive a further prize for being named the Final Winner.

10. Other terms

10.1 HI reserves the right to provide a substitute Destination should the original Destination become unavailable for reasons beyond its control. Prizes are non-changeable and non-transferable. No cash or credit alternatives are offered. No upgrades are allowed/Any Winner may upgrade the flights at their own expense.

10.2 All third parties, such as, but not limited to, it’s member National Association hostels, terms and conditions, connected to the prize apply and Winners are expected to abide by those terms and conditions.

10.3 HI, its member National Association hostels or its partners accept no liability for any loss or damage which any Eligible Participants or Winners may suffer as a direct or indirect result of entering this Competition.

10.4 This Agreement does not constitute any form of employment by HI to the Winners.

10.5 HI reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Competition with or without prior notice due to reasons outside its control.

10.6 HI reserves the right at any time to change these terms and conditions.

10.7 HI may terminate this Agreement upon written notice for any of the following reasons: (a) if he/she is unable to depart on the trip or to continue with the trip without good reason; (b) if he/she fails to keep to their proposed journey and itinerary without good reason or unless agreed with HI or it’s member National Association ; (c) if he/she brings or seeks to bring HI, it’s member National Association, its publications or the partners into disrepute; if he/she breaches any term of this Agreement.

10.8 By receipt of any prize, the Winners agree to release and hold harmless HI, it’s member National Association hostels and its respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of its respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Competition or receipt or use or misuse of any prize. Nothing in this clause shall serve to limit or exclude the Released Parties liability for death or personal injury caused by that Released Party’s negligence or breach of these terms and conditions.

10.9 HI is in no way liable for the reproduction or indirect access via third party websites or home page access or where any reproduction misstates or omits any of the information or terms and conditions connected with this Competition.

10.10 This competition is governed by the laws of England and Wales and is subject to the exclusive jurisdiction of the English Courts.
